Process for dealing with Court Orders

When you receive a Court Order made under the Protection of Personal and Property Rights Act 1988, you must:

  • confirm whether the court order is still current now
  • check what powers are granted by the Court Order
  • confirm what these powers will enable the agent to do on the client's behalf, in terms of dealing with Work and Income, Senior Services or Housing Assessment and
  • you must add the details of the agency to the client's CMS record, select the rights and responsibilities the agent is being granted and add notes in the comment field of the 'agent' to include details of:
    • the type of order
    • the expiry date

Consult your Service Delivery solicitor if you are unsure about a Court Order.

Complete "Appointment of an Agent" form

Even when a Court Order is provided, you should also request that the 'Appointment of an agent' form be completed as this provides us with information which may be used to identify the agent when they contact Work and Income, Senior Services or Housing Assessment.

While it is preferable that this occurs, it cannot be insisted upon.  In these cases, the agent (the person named in the Order) should complete the form, and the client's declaration will be left blank. The 'agent' also needs to provide two forms of identification for themselves.
