Inequitable in all circumstances

Before a debt can be regarded as non-recoverable under regulation 208 you must be satisfied that it is inequitable to require repayment.

You will need to consider the client's full circumstances, in particular:

• their financial position
• whether they have the resources to repay the debt
• the degree of any error made by Work and Income
