Review of Decision of debt
Where an application for Review of Decision involves a debt currently being recovered from a benefit, in most cases it will be appropriate to suspend repayments until the review and appeal process is completed.
You need to consider what aspect of the debt is under review before you suspend recovery:
- where establishment of the whole debt or the decision to recover is under review, ceasing recovery for the duration of the Review of Decision is appropriate
- where there is more than one debt, continue to recover the other debts not being reviewed
- where a client is reviewing a part of the debt (not the complete debt) you should continue to recover the portion of the debt not under dispute
Note you do not refund any repayments already deducted until the outcome of the review or appeal is known.
