Warrant to Arrest : Contents

Client has not taken all reasonable steps

If a client or partner has not taken all reasonable steps to resolve the warrant to arrest and the reason that they have been unable to do so is not due to reasons beyond their control, do not resume their benefit until they provide evidence they have resolved their warrant.

Once a client has cleared their warrant, their benefit can be resumed but it cannot be backdated. You can only resume it from the date they clear their warrant.

Example

A client contacts Work and Income because their benefit is suspended as they chose not to make an attempt to clear their warrant to arrest within the 10 working day notice period. They now say that the court won't be open until the end of the week.

Do not resume their benefit until they provide evidence they have cleared their warrant to arrest. This is because they did not take reasonable steps in the notice period to clear their warrant. The benefit will be resumed from the date they clear their warrant to arrest.
