Residence
To get Child Disability Allowance, a client must:
- be a New Zealand citizen or
- have a residence class visa in New Zealand under the Immigration Act 2009 or
- be deemed to hold a residence class visa in New Zealand under the Immigration Act 2009 and
- be ordinarily resident in New Zealand when they first apply for benefit and
- generally be ordinarily resident in New Zealand
Note for Child Disability Allowance no period of residence is required.
People who are in New Zealand unlawfully or here on a temporary entry class visa generally do not qualify for a benefit.
Clients without citizenship or a residence class visa
If a client does not have New Zealand citizenship or a residence class visa, they cannot get Child Disability Allowance.
However, if a client in this situation has disability costs for their child, they may be able to get Temporary Additional Support if they are:
- a person who has refugee or protected person status in New Zealand or
- awaiting the outcome of their application for refugee or protected person status and are lawfully in New Zealand (i.e. they have a valid temporary entry class visa under the Immigration Act 2009) or
- applying for a residence class visa under the Immigration Act 2009 and are compelled to remain in New Zealand due to some unforeseen circumstances
Once the client has been granted citizenship or a residence class visa and they meet all the other qualifications, Child Disability Allowance may be granted.
Australian clients
Australian citizens or residents are lawfully allowed in New Zealand, as they hold a residence class visa.
However, they must still be ordinarily resident in New Zealand and meet all other criteria to qualify for Child Disability Allowance.
