Recoverable Assistance Payment : Contents

Item or service not in client's name

Generally, immediate and essential needs are considered for a Recoverable Assistance Payment only if the item or service is in the client's or their family's (if any) name.

Essential items or services not in the client's or partner's name are not considered for a Recoverable Assistance Payment as the client or partner is not liable for the payments.

Exception

There may be situations where a client or their partner (if any) has entered into an informal arrangement with another person to pay for an essential item or service using the other person's name and/or credit rating for the contract.

You need to be satisfied that the client or their partner is the person with the immediate and essential need, and is required to make the payment for the item or service. You must also be satisfied it is/was the intention of the parties to the informal arrangement that the client or their partner would have responsibility for the payments, and the use and control of the essential item or service.

A full statement from the client or partner and the other person named in the contract is required along with a copy of the agreement to determine if the cost can be considered for a Recoverable Assistance Payment.

Note in these situations the client is not able to meet the cost of the item or service from their own resources and the need must be immediate and essential.
