Trust decisions

The assets held, income generated, and decisions made by the trust cannot be attributed to the client.

Role of trustee

A trustee is appointed to take care of the assets and income of the trust in a way that supports the needs of the trust beneficiaries. Trustees have a duty to make decisions in line with the terms of the trust deed.

Client is a trustee

Decisions made by a trust cannot be attributed to a single trustee. When the client is a trustee, decisions made by the trust cannot be attributed solely to the client. Decisions are being made in the role of trustee and not in the client's personal capacity.

Exception

The only time we can attribute trust decisions to the client is when they have full unrestricted control over the entire trust. This control must not be limited by the terms of the trust deed or the involvement of any other trustee.
