Second or subsequent separation

When a client reconciles with their former partner, and later separates for a second time they will not be required to 'prove' some aspects of eligibility again.

Work permit or visa

You should confirm their work permit or visa (if granted after 29 November 2010) is still current; Immigration New Zealand will have initially granted this.

Note that a work visa issued before 29 November 2010 does not allow a person to remain in New Zealand.

Proof of family violence

Provided proof of family violence by the partner was obtained from Immigration New Zealand for the first application, no further proof is required where the client separates for a second time due to family violence.

Relationship ended and hardship

You will need to confirm the relationship has ended and that the client is suffering hardship. It may also be appropriate to confirm the client's immigration status with Immigration New Zealand. See:

Advise National Office

You must advise National Office when a client 'resumes' applications for weekly Special Needs Grant payments under the Family Violence Programme. See:

New partner

Where a client forms a 'new relationship' and later separates due to family violence, you would need to refer the client to Immigration New Zealand and when appropriate, to the New Zealand Police to report the incident of violence and/or a refuge organisation for support.
