Allowable costs not in client's name

Generally, costs not in the client's or partner's name are not included in the assessment of Temporary Additional Support as the client or partner is not liable for the repayments.

There may be situations where a client or their partner has entered an informal arrangement with another person to purchase an essential item using the other person's name and/or credit rating for the hire purchase agreement.

You need to be satisfied that the client or their partner is the person making the payments and that it was the intention of the parties to the informal arrangement that the client or their partner would have responsibility for the payments and would benefit from the use and control of the item.

Note you must also be satisfied that the client is responsible for the cost and has the use of the goods or service is required. The onus is on the client in the first instance to provide any further information required. Ask for further information if you are not satisfied.

A full statement from the client or partner and the other party is required along with a copy of the purchase agreement to determine if the cost can be included in the Temporary Additional Support assessment.

To assist in making a decision as to whether the client is responsible for the cost the following should be considered:

Why are the goods or service in another person's name?
You will need to establish why the goods or service is not in the client's name. For example, but not limited to, is the client bankrupt and cannot obtain this essential goods or service item with their current credit rating?

Is it possible to transfer the goods or service into the client's name?

Has any other person contributed to the goods or service payments in any way?

Contact Helpline if you need assistance deciding whether or not the cost can be included.
