Outcome of case

Outcomes from mediation are strictly confidential to the parties involved, so any information about the settlement will have to be obtained from the client (or partner).

Where a client (or partner) wins their personal grievance case, and receives a wage settlement for a period during which a benefit with work obligations was paid:

  • review the client's (or partner's) entitlement date and non-entitlement period assessments and
  • establish any overpayments

If it is determined that the employer was not at fault, then a 13 week non-entitlement period for misconduct can be applied.

If the settlement order states that the payment or part payment is to cover legal or other costs, do not recover benefit received from the payment amount. If it is unclear what the client's (or partner's) settlement is for, contact Helpline for assistance.

If the case is settled but no party is admitting fault, a decision must be made as to whether the voluntary unemployed provisions apply. Use all evidence available but give the benefit of the doubt to the client (or partner). Contact your local solicitor for advice.
