Parent is being prosecuted under Education and Training Act 2020
All parents are legally obliged to ensure their children are enrolled in and attending school from the age of 6 to 16.
Parents can be prosecuted and fined under Education and Training Act 2020 if their children don't attend school. This can happen when:
- there has been, without explanation, ongoing and irregular attendance by the child at school after support has been offered to the family or
- the parent has made little or no attempt to do anything about ensuring the child attends school
If a parent is in the process of being prosecuted under Education and Training Act 2020, you must not ask them to comply with this social obligation or initiate an obligations failure for non-attendance.
Note you need to record this as an exception in OBMAN using 'Parent is in prosecution for truant child' as the obligation exception reason.
