Parent is being prosecuted under the Education and Training Act

All parents are legally obliged to ensure their children are enrolled in and attending school from the age of 6 to 16 years.

Parents can be prosecuted and fined under the Education and Training Act 2020 if their children don't attend school. This can happen when:

  • there has been, without explanation, on-going and irregular attendance by the child at school after support has been offered to the family or
  • the parent has made little or no attempt to do anything about ensuring the child attends school

If a parent is in the process of being prosecuted, you must not ask them to comply with the social obligation or initiate an obligations failure for non-attendance.

Note you need to record this as an exception in OBMAN using 'Parent is in prosecution for truant child' as the exception reason.
