Ministerial Direction - Single Living Alone Rates Amendment 2020

Gazette notice:
Number 4448, dated 23 September 2020

Effective date: 9 November 2020

This instrument, which comes into force on the day that it is signed by the Minister, amends the Ministerial Direction - Single Living Alone Rates. The instrument changes the current definition of house or flat to require the residence to have a sink with a tap connected to an adequate supply of water whether or not it is in the kitchen. It also inserts a new Clause 2A on the meaning of mobile home which provides criteria that must be met when determining whether a person's principal residence is a mobile home. This clause also provides guidance on what it means for a mobile home to be sufficiently self-contained.

Instrument amending Ministerial Directions and Welfare Programmes (No 2) 2018

Gazette notice:
Number 5345, dated 26 October 2018

Effective date: 26 November 2018

This instrument, which is made under sections 7 and 101 of the Social Security Act 2018 (the Act) and regulations 90 and 211 of the Social Security Regulations 2018 and comes into force on 26 November 2018, amends the Ministerial directions and welfare programmes under the Social Security Act 1964 (and saved by Schedule 1 of the Act) that are listed in the Schedule of this instrument in the manner set out in that Schedule. The amendments update references to provisions of the Social Security Act 1964 to equivalent provisions of the Act or the Social Security Regulations 2018 and for changes of language in the Act. It also revokes a spent direction and welfare programme.

Ministerial Direction - Living Alone Payments Amendment 2014

Gazette notice:
Number 7419, dated 4 December 2014

Effective date: 7 December 2014

This instrument, which comes into force on 7 December 2014, retitles and amends the Ministerial Direction - Living Alone Payments given under section 5 of the Social Security Act 1964 (the Act). The amendments reflect that living alone payments were replaced by the single living alone rate of New Zealand superannuation and veteran's pension by the Social Assistance (Living Alone Payments) Amendment Act 2013, but limit the scope of the direction to the assessment of entitlement to the single living alone rate of New Zealand Superannuation because of an amendment to section 5 of the Act made by the Veterans' Support Act 2014. The instrument also inserts clause headings in the direction.

Ministerial Direction - Living Alone Payments Amendment 2006

Gazette notice:
Number 4639, dated 13 July 2006

Effective date: 1 July 2006

This amendment revokes the provisions of the Ministerial Direction - Living Alone Payments relating to sharing of household expenses with effect on 1 July 2006. Amendments to section 13 of the New Zealand Superannuation and Retirement Income Act 2001 and section 74U of the War Pensions Act 1954 that come into force on that date mean that a person sharing household expenses is no longer disqualified from receiving a living alone payment.

Ministerial Direction - Living Alone Payments Amendment 2005

Gazette notice:
Number 4098, dated 30 June 2005

Effective date: 1 July 2005

This amendment to the Ministerial Direction - Living Alone Payments, which comes into effect on 1 July 2005:

  • updates references to the statutory provisions relating to living alone payments;
  • omits the provision requiring an applicant to have a right to exclusive occupation of the residence occupied;
  • changes clause 3 of the direction so that regular contributions in a substantial way to the total cost of the applicant's household expenses are considered to be the sharing of household expenses, instead of direct or indirect contributions to the cost;
  • clarifies that the sharing of a joint bank account between the applicant and his or her spouse or partner is not by itself considered to be the sharing of household expenses;
  • omits the example.
