Age
To qualify for social housing a client must be aged 16 years or over.
Entering a tenancy agreement
To enter into a tenancy agreement there must be a person who can be a signatory to the tenancy agreement.
To be a signatory, a client must be aged:
- 18 years or over or
- 16 or 17 years and either:
- be (or have previously been) married or in a civil union or
- single or in a de facto relationship if they have been approved by the Tenancy Tribunal to enter a tenancy agreement for social housing they have been offered
Clients under 18 years
Young people aged 16 or 17 years can qualify for social housing but placement into a property (that is, signing a tenancy agreement) depends on the age restrictions that make a tenancy agreement legally enforceable.
Clients aged 16 or 17 years old cannot sign and enter into a tenancy agreement by themselves unless they are (or have previously been) married or in a civil union.
Clients who are not (or have never been) married or in a civil union
Clients aged 16 and 17 years old who are not (or who have never been) married or in a civil union can obtain approval from the Tenancy Tribunal to enter into a tenancy agreement that is legally enforceable. The social housing provider will discuss this extra process with the young person at the time they are offered a property.
If a young person is unable to enter into a tenancy agreement because of their age they are removed from the register.
