Review of decision of Income Related Rent debt
Clients can have a decision reviewed when they disagree with the establishment and recovery of any Income Related Rent debt.
Debt recovery can be suspended
When an application for a Review of Decision involves a debt currently being recovered, in most cases it is appropriate to suspend repayments until the review and appeal process is completed.
You need to consider what part of the debt is being reviewed before you suspend recovery:
- when establishment of the whole debt or the decision to recover is under review, stopping recovery for the period of the Review of Decision is appropriate
- when there is more than one debt, continue recovering other debts not being reviewed
- when a client is reviewing a part of the debt (not the complete debt) you should continue recovering the part of the debt not under dispute
Note you do not refund any repayments already deducted until the outcome of the review or appeal is known.
