Tenant has a property order
Sometimes a tenant or other person may have a property order for the social housing property.
Property orders, which include occupation or tenancy orders, are granted by the Court under the Family Violence Act 2018.
Under a property order, a tenant or other person living in a social housing property may be granted the right to occupy, or the tenant may have legal right to the tenancy for a specified period.
Orders may be temporary or permanent.
If a tenant (or other person) tells MSD they have a property order for the social housing property, MSD should ask for a copy of the order from the tenant (or other person). Staff should then refer the matter to Helpline. This is to confirm whether or not the tenancy review may continue.
