Agent appointed by a Court Order

In certain circumstances, the Courts may appoint an individual to act on behalf of someone who is incapacitated. These Court Orders are made under the Protection of Personal and Property Rights Act 1988. The Court Order will list the rights and powers granted to the person named, or any restrictions to these rights and powers.

When a Court Order is provided, you should also request that the 'Appointment of an Agent' form be completed.

This provides us with information which may be used to identify the agent when they contact StudyLink. While it is preferred that this occurs, it cannot be insisted upon.

In these cases, the agent (the person named in the Order) should complete the form, and the student's declaration will be left blank. The agent needs to provide two forms of identification.
