Overpayments
When a New Zealand benefit or pension being paid in Denmark is overpaid you will need to advise the client:
- the reason for the overpayment
- the amount of the overpayment
- their review and appeal rights and
- the relevant section of the legislation or article of the agreement
The overpayment can be recovered by regular deductions from any New Zealand benefit or pension that the client is receiving.
If the client is no longer receiving a New Zealand benefit or pension the Danish authorities will recover the overpayment from any current Danish pension payments.
The Danish authorities will reimburse New Zealand each September for any overpayments recovered during the previous year.
If the client is no longer receiving any benefit or pension they will need to make arrangements to repay the debt themselves.
Review or appeal
If a client applies for a review or appeals a decision on the establishment of a debt or the rate of recovery, recovery action will be suspended until the outcome of that review or appeal is known.
