Overpayments
When a New Zealand Superannuation or Veteran's Pension being paid in Malta is overpaid you will need to advise the client:
- the reason for the overpayment
- the amount of the overpayment and
- their review and appeal rights
The overpayment can be recovered by regular deductions from the New Zealand Superannuation or Veteran's Pension the client is receiving.
If the client is no longer receiving a New Zealand Superannuation or Veteran's Pension there is no provision in the agreement with Malta for the Maltese authorities to recover the overpayment on New Zealand's behalf. There is also no provision in the agreement with Malta for New Zealand to recover Maltese debts.
Review or appeal
If a client applies for a review or appeals a decision on the establishment of a debt or the rate of recovery, recovery action will be suspended until the outcome of that review or appeal is known.
