Pre-benefit activity no longer reasonable for a partner
If, once assigned, a partner is unable to complete a pre-benefit activity MSD can revoke the requirement if completing the activity is no longer reasonable.
Circumstances that may result in the activity no longer being reasonable could include (but is not limited to) where:
- there has been a deterioration in the client's or partner's health condition, injury or disability
- there has been a death or illness in the family
- the partner has a literacy or numeracy issue which was not evident when the activity was assigned
If MSD decides to revoke a pre-benefit activity because it is no longer reasonable, MSD must advise the partner that the pre-benefit activity is no longer required.
Example
A partner has applied for Jobseeker Support and has a pre-benefit activity assigned to attend an employment-related seminar provided by MSD. The partner had an accident and is in hospital. In this situation attending an employment-related seminar is no longer reasonable.
MSD must let the partner know that they do not have to attend the seminar, and the requirement to do so has been removed.
Legislation
- Regulations may prescribe pre-benefit activities section 184 Social Security Act 2018
- Requirements related to activities regulation 110(4) Social Security Regulations 2018
