Other circumstances beyond a client's control
There may be other reasons a client or partner is unable to clear their warrant that are beyond their control.
In these circumstances, where a client or partner has taken all reasonable steps but has still been unable to resolve their warrant, we would resume their benefit from the date that it suspended and give them another 10 working days to resolve their warrant.
Circumstances may include (but are not limited to):
- client or partner is in hospital
- client or partner has limited funds for transport and has no other way to get to the court but has made a priority for the next pay day
- the court is outside of the client's town and the public transport or alternative form of transport is not available until a later date
- client or partner is challenging that the Warrant to Arrest applies to them (Integrity Intervention Centre will resume in this case)
- a client or partner receives the letter during the 10 working day notice period and then advises that they have been in hospital for 10 days and
- there was no time for them to address this before they entered hospital and
- they advised us as soon as they left hospital
- a client or partner receives the letter during the 10 working day notice period and hasn't been able to address this because a close family member dies
- client or partner was overseas during the notice period and did not receive the letter until they returned
Generally, we would not give the client more than 10 working days to clear their warrant to arrest from when they notify us of the reason why they have not already been able to do so.
However, in some circumstances, a client may need longer than 10 working days to clear their warrant. In these cases, the benefit may be able to be extended for a further 10 working days.
