Partner accepts the results of a failed screening test
A client will be asked by the employer, training provider or the drug test provider to confirm that they accept the result of the failed screening test. They can accept the result of the failed drug test by:
- signing the Pre-employment Drug Test Result Confirmation Form or
- verbally accepting the result
When a client has accepted the results, this means that they understand:
- there is no requirement to send the failed screening test sample to a laboratory for evidential testing
- this may result in a sanction being imposed and
- they may have to repay Work and Income for the cost of the failed drug test
Before you initiate an obligations failure for a partner because they have failed a drugs test, without having a good and sufficient reason, you must receive confirmation from the employer that the partner has failed the test.
Once you have received confirmation from the employer or training provider that a client has failed the screening test, and all testing has been completed, an obligations failure should be initiated.
Although the client can still dispute other parts of the decision, by providing a good and sufficient reason for the obligations failure, they cannot dispute the result of the screening drug test because they have already accepted the failed result.
