Recompliance through employment
Full-time employment
A partner with full-time work obligations who has a 13 week non-entitlement period applied can recomply through participation in full-time employment. The employment must be for a continuous period of at least 6 weeks.
At the end of the 6 week period of employment the 13 week non-entitlement period ends. The partner needs to reapply if they wish to receive a benefit. The benefit is granted from the date the employment ceased.
Note provisional benefit is not paid during the 6 week period of employment.
Part-time employment
A partner with part-time work obligations who has a 13 week non-entitlement period applied can recomply through participation in part-time employment for a period of at least 6 weeks.
The part-time employment needs to be for an average of 20 hours or more each week.
At the end of the 6 week period of employment the 13 week non-entitlement period ends. The partner needs to reapply if they wish to receive a benefit. The benefit is granted from the date the employment ceased.
If the partner leaves this employment before the end of the 6 week period without a good and sufficient reason or through misconduct, any provisional benefit paid must be established as a debt and the remainder of the non-entitlement period is imposed.
The partner may still recomply during the remainder of the 13 week non-entitlement period by participating in another approved activity.
Note the income received from the part-time employment is charged against the benefit rate.
For when to grant or increase the benefit, see:
