Recompliance (13-week non-entitlement period)

A client or partner can complete certain activities to get a provisional benefit if they have a 13 week non-entitlement period due to:

  • leaving a job voluntarily
  • losing a job through misconduct
  • having a grade 3 sanction imposed or

If a client or partner wants to recomply, you must make a 6 week approved activity or programme of activities available to them at the earliest opportunity.

There is no waiting period before an approved activity can start, after a sanction has been imposed.

Recompliance activities

The client or partner must undertake an approved activity for a continuous period of 6 weeks or until the 13 week non-entitlement period ends (whichever is the earlier). This can be through:

  • satisfactory participation in a 6 week approved activity or programme of activities
  • satisfactory participation in full-time employment or
  • part-time employment (in the case of clients with part-time work obligations)

Note that for clients with full-time obligations the 6 week approved activity should be full-time, and for clients with part-time obligations it should be part-time.

Recompliance for social obligations

If a client or partner fails their obligations for a third time, and the third failure is a social obligation failure, then the 6 week recompliance activity you require the client or partner to complete will be different.

In this situation it may not be appropriate to require the client or partner to complete a 6 week approved activity that is focused on work outcomes, so a programme of short-term approved activities may be more appropriate for the client or partner.

For more information see:

Approved activity examples

Here are some examples that may be a suitable 6 week approved activity for the client or partner:

Note this list is an example only, an approved activity (or programme of suitable activities) should be relevant to the obligations failure and be fair and reasonable.

Programme of suitable activities

If there is not an appropriate 6 week approved activity available, consider establishing a programme of suitable activities.
