Recompliance (13 week non-entitlement period)
A client can complete certain activities to get a provisional benefit if they are subject to a 13 week non-entitlement period due to:
- leaving a job voluntarily
- losing a job through misconduct
- having a Grade 3 sanction imposed or
- refusing an offer of suitable employment
If a client wants to recomply, you must make a 6 week approved activity or programme of activities available to them at the earliest opportunity.
There is no waiting period before an approved activity can start after a sanction has been imposed.
Recompliance activities
The client must undertake an approved activity for a continuous period of 6 weeks or until the 13 week non-entitlement period ends (whichever is the earlier). This can be through:
- satisfactory participation in a 6 week approved activity or programme of activities
Recompliance for social obligations
If a client fails their obligations for a third time, and the third failure is a social obligation failure, then the 6 week recompliance activity you require the client to complete will be different.
In this situation it may not be appropriate to require the client to complete a 6 week approved activity that is focused on work outcomes, so a programme of short-term approved activities may be more appropriate for the client.
For more information see:
Programme of suitable activities
If there is not an appropriate 6 week approved activity available, consider establishing a programme of suitable activities.
For when to grant or increase the benefit, see:
