Review of decision - 26 week reapplication process
The client cannot review the requirement to complete the 26 week reapplication process as it is a statutory requirement to reapply - rather than a reviewable decision made by MSD.
However a client can apply for a Review of Decision of the 26 week reapplication process when:
- they do not agree with a decision regarding the regrant of their Jobseeker Support, such as the benefit or supplementary assistance being paid at a different rate or being declined, or
- they have provided a reason for not reapplying in time which was not deemed by MSD to be an exceptional circumstance.
Note this is also applicable for clients who are required to complete the 52 week reapplication process on or after 1 July 2025 as a transitional arrangement.
Automated decision making
Where Automated Decision Making is used to determine that a client has satisfied all parts of the reapplication and continues to qualify for Jobseeker Support, their benefit is automatically regranted.
If MSD or the client does not agree with the decision to automatically regrant the benefit, MSD can review the decision.
A client can then apply for a Review of Decision if they do not agree with the outcome of MSD's review of the decision made through Automated Decision Making.
