Obligations of a signatory

In signing the tenancy agreement as a joint tenant, the person must understand their obligations.

These obligations include that both signatories to the tenancy agreement will be:

  • responsible for the tenancy
  • liable for any debt incurred
  • liable for any damage caused (even if the other joint tenant or third party caused the damage)
  • subject to review of their ongoing eligibility for social housing

It is the responsibility of the social housing provider to discuss these obligations with the signatories to the tenancy agreement.

Social housing providers are housing providers, which include Housing New Zealand and community housing providers.

Community housing providers are approved, registered and regulated by the Ministry of Business, Innovation and Employment.

A social housing provider can provide properties for tenants who are eligible for social housing and for subsided rent through Income Related Rent.
