Unreasonable to expect the information to have been provided earlier
When determining the date that the change in circumstances occurred, consider whether it was unreasonable to expect the tenant to have advised of the changes any earlier.
Consider whether the reason provided:
- was unforeseen, out-of-the ordinary and could not be planned for
- was beyond the client's control or
- sets the client apart from others in a similar situation
Examples include (but are not limited to):
- unforeseen hospitalisation
- seriously sick or injured
- bereavement of immediate family
- emergency or adverse event
- victim of violent crime (including family violence)
If you consider it was unreasonable for the information to have been provided earlier, the refund is paid for the period between earliest possible rent charge date (following the day the change in circumstance occurred) to the day prior to the rent effective date that the correct rate of Income Related Rent was applied.
