Challenging a warrant to arrest
If the client thinks that the warrant to arrest has been issued to the wrong person, they can challenge the warrant to arrest.
This can be either a challenge to the Ministry of Social Development's data match, or to the identity information held by the Ministry of Justice.
Where a client challenges a warrant to arrest, Work and Income will not take any action to suspend their benefit until the challenge has been resolved.
Note a client can challenge a warrant at any point. This process is managed by the Integrity Intervention Centre (IIC). Depending on the challenge reason, the Integrity Intervention Centre will give the client the appropriate amount of time to resolve the challenge.
As soon as a client advises Work and Income that they are challenging the warrant, the benefit will not suspend. If the benefit has already been suspended, then it must be resumed from the suspension date.
Evidence may need to be provided from the Ministry of Justice or the police.
