Outgoings paid by former partner - non-beneficiaries

The amount of outgoings paid by the person's former partner to be charged as income depends on whether or not there has been a Relationship Property Settlement (previously Matrimonial settlement) - whether by Property Agreement or Property Order.

Before the property settlement

In the case of a non-beneficiary, before the property settlement, charge as income against the Accommodation Supplement any outgoings the former partner is paying in excess of 50% of the total outgoings.

After the property settlement

After property settlement there should be an agreement stating the amount of accommodation costs to be paid by each partner. Any amount, over the agreed amount, paid by the former partner towards the property is charged as income against the Accommodation Supplement in the case of a non-beneficiary.

Accommodation costs

Accommodation costs are considered to be the amount a person actually pay's for their accommodation, not the total accommodation cost of the home.
