Date when work obligations apply from (health condition, injury or disability)
Once you have made a decision about whether the client receiving Jobseeker Support (health condition, injury or disability) should have part-time work obligations or work preparation obligations, you will need to determine the date the client's obligations will apply from. The information in the client's Work Capacity Medical Certificate will help you to determine:
- work preparation obligations will apply from the date the client has reduced capacity
- part-time work obligations apply after a five day notice period from when the client was sent a letter advising them of their part-time work obligations
Clients applying for Jobseeker Support (health condition, injury or disability)
Clients applying for Jobseeker Support must be given notice in writing that they will have work obligations or work preparation obligations. To do this, you must:
- note on the client's obligations section of the application form that you have decided they should have work obligations and
- give the client a copy of their obligations from the application form
The work obligations will apply from:
- the client's commencement date or
- the date you grant the benefit in SWIFTT
whichever is the later.
For more information see:
Work obligations - client is already receiving Jobseeker Support (health condition, injury or disability)
Clients receiving Jobseeker Support will be given a five working day notice period before their work obligations will apply. The five-day notice period begins when a letter is sent to the client advising them of their part-time work obligations. A client cannot be subject to work obligations until they have received notice in writing.
The five working days is counted automatically from the date after the letter has been sent. The table below provides an example of how to count the notice period:
Case manager enters that the client has part-time capacity to work | |
Day 0 | A letter is sent explaining to the client that work obligations will apply from Day 6 |
Day 1 and 2 | Five working day notice period begins |
Weekend | Saturday - Sunday |
Day 3 - Day 5 | Five working day notice period continues |
Day 6 | Work obligations applied in SWIFTT |
Applying work obligations from a future date
When a client provides a medical certificate prior to their current expiry date in SINCC the client will be sent a letter advising that they will have work obligations (once the medical certificate is processed). The date that the client will be subject to work obligations will be:
- the day after the five working day notice period or
- the date the medical coverage begins
whichever is the later.
Note clients cannot be subject to work obligations from a date in the past.
