Decision guidelines - clients moving to a limited employment location

Clients who move to a limited employment location must continue to meet their work obligations.

This includes being available for, and taking reasonable steps to obtain, suitable employment. To meet this obligation, they must demonstrate that they:

  • have access to reliable transport
  • are willing to commute to a nearby town or centre where suitable employment is available
  • are realistically able to commute to a nearby town or centre where suitable employment is available

It is up to the client to demonstrate to you how they are meeting their work obligations. If the client is not meeting their work obligations, you must initiate a work obligations failure.

Work obligations failure - recompliance

Once a work obligations failure has been initiated, the client must show their willingness to meet their work obligations by:

  • demonstrating they have reliable transport, and are willing and realistically able to commute to a nearby town or centre where employment is available or
  • moving to a place that is not a limited employment location

A client who agrees to recomply by moving to an area that is not a limited employment location will need to show you they have taken steps to move before they can be considered to have recomplied.

You will need to keep in regular contact with your client to ensure they are continuing to take steps to move.

Where it is not possible to remedy the relevant failure, the client may recomply by completing another activity that is the same or substantially similar to the activity they failed.

Ongoing work with clients who move to limited employment locations

If your client can demonstrate they will meet their work obligations in a limited employment location, you will need to work closely with them to ensure they actively continue to meet these obligations.

Your client should be encouraged to:

  • keep a verifiable record of what they have been doing each week to find employment and
  • meet with you on a regular basis
