Drug test recompliance count
The obligation failure that is initiated or the sanction that is imposed depends on how often the client or partner has failed to comply with their obligations in the previous 24 months while getting a benefit. This is called the 24-month failure count.
The recompliance activity that the client or partner has to complete depends on whether the client or partner has failed their drug test obligation before within the last 24 months.
To recomply with a third failure of any obligation the client or partner must complete a 6-week approved activity.
Example 1
Obligation / activity failed | Recompliance | 24 month failure count |
Work obligations - failed pre-employment drug test requirement | Drugs test recompliance 1 eg must verbally agree to stop using drugs | Obligations failure 1 or Grade 1 sanction |
Work obligations - refused to apply for a job due to pre-employment drug test requirement | Drugs test recompliance 2 eg - agree to take and pass a drug test within 25 working days (of the agreement) | Obligations failure 2 or Grade 2 sanction |
Example 2
