Exemptions
Exemptions from obligations may apply as there are a number of specific reasons why it is unreasonable to expect a client to meet their work preparation obligations or work obligations for a specified period.
A client can be granted an exemption from some or all of their work preparation or work obligations. Proof may be required before an exemption is granted.
Clients with a deferral from their work obligations
Clients who have been a deferral from their work obligations, still have work preparation obligations. These clients may also qualify for an exemption from their work preparation obligations if they are unable to plan towards a return to work.
For more information see:
If you think the client or partner should be granted a temporary exemption, add the exemption on the SWTDA screen using the appropriate reason code. You must also add an expiry date.
Note a temporary exemption for partners with a health condition, injury or disability is entered in the SINCC screen. This means the partner's medical information is applied the same as if they were a primary client. For more information see:
Duration of the exemption
Each exemption has a specific duration for which it can be granted. In some instances these can be extended (if appropriate).
