In approved study before subject to work obligations
This exemption may apply to partners with work obligations.
A partner with their youngest dependent child aged 3 years or over can be exempt from meeting some or all of their work obligations if they were in approved study at the time they became subject to work obligations.
This would cover situations where a partner was:
- part way through a course of study at the time that they were required to meet work obligations
- part way through a course of study when their youngest dependent child reached the age of 3 years
Note this can be a full or partial exemption.
Also note the partner must be passing the course of study and it must be completed within two years of being required to meet work obligations.
Proof
The partner has to provide evidence that they are involved in study, such as:
- enrolment forms
- academic transcript, showing that they have passed 50% of their course the previous year
- training statement
Duration
The exemption can apply for up to 12 months or until their current course of study has finished or the end of the current academic year - whichever is earliest.
The partner has to obtain a new exemption for the following year if the study is continuing and show evidence that they have passed at least 50% of their course the previous year.
