Restricted circumstances guidelines

You must consider the following factors in relation to the restricted circumstances that make the child's attendance at school unreasonable.

It can be unreasonable for that child to attend school:

  • if there is no school bus or
  • no other suitable transport and
  • there is a significant distance between their home and school

It may also be unreasonable for the child to attend the nearest school because the child has particular needs that prevent them from attending the nearest school, for example:

  • special needs such as physical or intellectual disability; chronic or recurring illness
  • learning or behavioural difficulties or
  • exclusion from the school

A person with an intellectual disability has intellectual functioning significantly below average. They may also have limitations with their behaviour (either behavioural problems or difficulty with managing day to day tasks or both).

An intellectual disability is not an illness or a disease and there may be various causes, for example; genetic, chromosomal abnormality or injury. One example of intellectual disability is Down Syndrome.
