Reviews and Appeals for fast-track

An applicant has the right to ask MSD for a review if they disagree with a decision relating to the assessment of their eligibility for social housing.

However, there is no right to appeal a decision relating to the application of fast-track under the Social Security Act 2018 or the Public and Community Housing Management Act 1992.

When a client does not agree

When a client disagrees with a decision regarding fast-track there is no right of review to a Benefits Review Committee or the Social Security Appeal Authority.

However, when a client does not agree with a fast-track decision, this decision should be reconsidered.

The reconsideration should be based on whether an informed decision was made and should consider the following:

  • reasons for the original fast-track decision
  • relevant policy and fast-track criteria
  • the information provided at the time
  • any new information on hand and
  • the reason the client disagrees with the decision

Note if the client does not agree with the fast-track decision following it being reconsidered, there are no rights to appeal the decision.
