Risk rating for lack of security of tenure

Security of tenure of current accommodation considers how many days before the client must leave their current accommodation. That is, what notice period (whether formal or informal) they have been given?

Note this does not apply to clients who have been assessed as 'not living in any accommodation', or being in emergency housing for the time being. These clients have already been assessed as 'at risk' (4) for adequacy.

There are 4 levels of risk rating for security of tenure

At risk (4)

Client needs to move within 7 days or less due to:

  • notice to vacate current accommodation
  • no permanent accommodation and staying as a 'temporary resident' in a permanent private dwelling where they or their families personal health or safety is at risk
  • ready to leave institutional accommodation (eg psychiatric hospital, prison, youth justice)
  • in a property that has been illegally sublet to the client

Serious housing need (3)

Client needs to move in 8 to 60 days due to:

  • notice to vacate current accommodation
  • no permanent accommodation and staying as a 'temporary resident' in a permanent private dwelling where the situation is not sustainable (this is their friends or family have asked them to leave)
  • ready to leave institutional accommodation (eg psychiatric hospital, prison, youth justice)
  • in a property that has been illegally sublet to the client

Moderate need (2)

Client needs to move in 61 to 90 days due to:

  • notice to vacate current accommodation
  • no permanent accommodation and staying as a 'temporary resident' in permanent private dwelling where the situation is currently sustainable (that is, the people they are staying with haven't asked them to leave)

Low or no need (1)

Client has no specific time to move:

  • notice to vacate with no time limit specified
  • no requirement to move from current accommodation

Temporary resident in a private dwelling

A temporary resident in a permanent private dwelling is a person staying in a house, flat, or apartment which may be owned or rented by another person.

Someone is a temporary resident when the:

  • expectation is that the living situation will not be long-term and
  • the length of stay is ultimately controlled by those who live in the house or flat permanently
