Requesting information to assess whether tenant still qualifies for social housing

When checking if the tenant still qualifies for social housing, as part of a tenancy review, MSD can contact any person in writing to request information.

MSD can also write to and ask any person to check if the information given by the tenant is correct.

Timeframe for tenant to provide information

The tenant must provide this information:

  • no later than 5 working days after the notice was given and
  • in the form that it is asked for (this may be attending a meeting or providing verification in writing)

Information a person must provide to MSD

A person may be required to provide information to MSD under section 125 of the Public and Community Housing Management Act 1992.

However, there is some information MSD cannot ask for. This includes information protected from disclosure under legal professional privilege (e.g. legal advice).

Consequences for tenant of not complying

If the tenant doesn't provide the information, or MSD considers they have deliberately given false or misleading information, MSD can check if they qualify for social housing based on the information MSD has about their circumstances.

They will be sent a letter which advises them:

  • they need to attend a meeting to discuss whether they still qualify for social housing and
  • the consequences if they do not attend

Legislation

Social housing is also known as Public housing.
