Tenant is exempt from 3 yearly tenancy reviews

Some tenants are exempt from 3 yearly tenancy reviews.

Tenants are exempt when they or their partner:

  • have a dependent child or dependent children in their care or
  • are 65 years of age or older or
  • get Supported Living Payment

Note a tenant or their partner who gets Supported Living Payment (caring) does not have to be living in the same property as the person they're caring for, to qualify for an exemption.

All tenants (including those exempt from 3 yearly reviews) may still have a tenancy review when:

  • they have a change in circumstances that may mean:
    • they no longer qualify for social housing or
    • their property no longer meets their needs (requirements)

Lifetime tenure - full exemption from tenancy reviews

Tenants with lifetime tenure are exempt from tenancy reviews even if they have a change in circumstances or no longer qualify for social housing.

Lifetime tenure is when Kāinga Ora has taken over a property from either a local authority, council controlled organisation or a council-controlled trading organisation (as defined in the Local Government Act 2002) and made a commitment to allow the tenant to stay in the property for the rest of the tenant's lifetime.

Kāinga Ora must verify that a tenant has lifetime tenure.
