Overpayments
When a New Zealand benefit or pension being paid in Canada is overpaid you will need to advise the client:
- the reason for the overpayment
- the amount of the overpayment
- their review and appeal rights and
- the relevant section of the legislation or article of the agreement
The overpayment can be recovered by regular deduction from any New Zealand benefit or pension that the client is receiving.
If the client is no longer receiving a New Zealand benefit or pension they will need to make arrangements to repay the debt.
Overpayments cannot be recovered from the client's Canadian pension.
Reviews or appeals
If a client applies for a review, or appeals a decision on the establishment of a debt or the rate of recovery, recovery action will be suspended until the outcome of that review or appeal is known.
