Other exceptional circumstances
In determining whether a client has any other exceptional circumstance for not completing their reapplication for Jobseeker Support before their expiry date, MSD must consider if they meet the criteria for exceptional circumstances.
The criteria for considering whether a situation or event is an exceptional circumstance, is that it is:
- is unforeseen, out-of-the ordinary and could not be planned for, and
- beyond the client's control, and
- those which set the client apart from others in a similar situation
Also that:
- the exceptional circumstance situation or event happened at any time during the client's notice period, and
- the event has affected their ability to reapply for their benefit
Note other exceptional circumstances may include an emergency or adverse event where no local or national state of emergency has been declared, or where the emergency or adverse event has ended but the client is still affected by the event at the time their "initial notice to reapply" letter is sent.
MSD will need to assess each case on its own merits when determining whether other exceptional circumstances exist.
Evidence
Clients may be asked to provide evidence. Evidence required will depend on the client's situation, and must be deemed satisfactory by MSD.
