Unclear whether client has the capacity to work

If it is unclear whether a client, who is receiving Jobseeker Support on the grounds of a health condition, injury, or disability, has the capacity to work at least 15 hours per week in open employment, MSD may:

  • ask the client questions to clarify the information
  • consult their Regional Health Advisor or Regional Disability Advisor for clarification of the client's capacity for work and limitations

Regional Health Advisor or Regional Disability Advisor

MSD can seek advice from their Regional Health Advisor or Regional Disability Advisor when:

  • a diagnosis is unclear
  • assistance is needed to interpret specialist assessments and medical information or reports
  • the extent a client's health condition or disability impacts on their ability to work is unclear, for example when the information on the medical certificate is inconsistent with what the client has told MSD
  • additional support around their health condition or disability has been suggested by the registered practitioner completing the certificate.

If a decision still cannot be made, MSD may require a second opinion from a designated health practitioner before making a decision about whether to apply part-time work obligations.
