Recomplying more than one failure
When more than one obligation failure has been initiated for a client on the same day, to increase, resume, or continue their full benefit the client or partner needs to successfully dispute or recomply to all the failures.
If the client disputes or recomplies with one obligation, the sanction must still be imposed due the other obligation failures not being successfully disputed or recomplied (within the 5 working day notice period).
Client already has a failure in-progress or a sanction imposed
Once failures have been initiated, and the notice letter has been sent, any further failures cannot be initiated until each failure:
- has been recomplied with
- has been successfully disputed because the client provided a good and sufficient reason or reasons or
- is overturned (following a dispute)
These further failures will not be included in the 24 month count and the client cannot be required to recomply.
