Housing provider requires a tenant to transfer

Once a client has been allocated a property, a social housing provider may:

  • review a client's requirements to be or continue to be allocated, or rent a particular house

and

  • require a client to transfer to a different house belonging to that provider if they consider the transfer is necessary or desirable for any reason and the other housing is appropriate for the tenant's housing needs

This process can be completed by the social housing provider without any review of the client's housing needs by MSD.

Kāinga Ora moves tenants for business reasons

Currently Kāinga Ora only requires a tenant to transfer for business reasons. As a result of their activities as a landlord or for other business reasons Kāinga Ora may identify that a property needs to be vacated. These reasons may include (but are not limited to) when the property:

  • is an earthquake risk
  • lease is expiring
  • is being re-developed
  • can be better utilised
  • is going to be sold

Generally Kāinga Ora will transfer the client and their household to another equivalent property. For example, a household currently living in a 3 bedroom property that has been identified as an earthquake risk will be transferred to another 3 bedroom property.

Review of clients housing needs (requirements)

The housing provider may ask MSD to complete an assessment of housing needs.

Income Related Rent

When a housing provider requires a tenant to transfer, the client's calculated rate of Income Related Rent remains the same, unless:

  • the client has a change of circumstances that changes the rate or
  • an annual review of the Income Related Rent is completed or
  • the rate of Income Related Rent is higher than the market rent rate
